Tesis ini berjudul Perjanjian Kerjasama Pembiayaan Kesehatan Masyarakat antara BPJS Kesehatan Dengan RSUD Palembang BARI Pada Masa Covid-19, Pandemi Covid-19 ini mengakibatkan banyak kendala pada berbagai sektor, salah satunya dampak terhadap perjanjian pembiayaan kesehatan yang dilaksanakan oleh BPJS Kesehatan dengan RSUD Palembang BARI. Permasalahan yang dibahas dalam penelitian ini adalah bagaimana bentuk dan proses pembentukan perjanjian kerjasama pembiayaan kesehatan masyarakat antara BPJS Kesehatan dengan RSUD Palembang BARI sebelum masa pandemi Covid-19 dan apakah perjanjian tersebut memadai dan mendukung untuk di gunakan pada masa pandemi Covid-19, lalu apa akibat hukum jika BPJS Kesehatan terlambat membayar tagihan yang ditagihkan oleh RSUD Palembang BARI, juga bagaimana konsep perjanjian kerjasama pembiayaan kesehatan yang sesuai untuk digunakan oleh para pihak agar memadai dan mendukung untuk di gunakan pada masa pandemi Covid-19. Jenis penelitian yang digunakan pada penelitian ini adalah jenis peneltian normatif, Pendekatan yang digunakan pada penelitian ini adalah pendekatan undang-undang dan pendekatan kasus. Teknik penarikan kesimpulan dilakukan secara deduktif. Dari hasil penelitan ini dapat disimpulkan bahwa perjanjian ini berbentuk perjanjian tertulis yang dibakukan dimana hal ini menghalangi para pihak untuk memformulasikan kehendak, dan perjanjian ini dinilai belum memadai untuk digunakan pada masa Covid-19 juga untuk keterlambatan pembayaran akan ada denda yang dikenakan terhadap BPJS Kesehatan, serta konsep perjanjian yang sesuai adalah perjanjian yang mengutamakan pelayanan kepada masyarakat bukan bisnis semata serta beberapa penambahan dan perbaikan klausul perjanjian ini. ABSTRACT the title of this thesis is Public Health Financing Cooperation Agreement between BPJS Health and RSUD Palembang BARI During the Covid-19 pandemic, the Covid-19 pandemic caused many obstacles in various sectors, one of which was the impact on the health financing agreement implemented by BPJS Health and Palembang BARI Hospital. The problems discussed in this research are, how the form and process of forming a public health financing cooperation agreement between BPJS Health and RSUD Palembang BARI before the Covid-19 pandemic period and whether the agreement was adequate and supportive to be used during the Covid-19 pandemic, then what were the law consequences if BPJS Health late in paying the bill which billed by the RSUD Palembang BAR , also how is the concept of a health financing cooperation agreement that is suitable for use by the parties so that it is adequate and supportive to be used during the Covid-19 pandemic. The type of research used in this research is normative research. The approach used in this research is the law approach and the case approach. The technique of drawing conclusions is deductive. From the results of this research, it can be concluded that this agreement is in the form of a standardized written agreement where this prevents the parties from formulating their will, and this agreement is considered inadequate to be used during the Covid-19 pandemic as well as for late payments there will be fines imposed on BPJS Health, and the concept of a suitable agreement is an agreement that prioritizes service to the community not just business as well as several additions and improvements to the clauses of this agreement.
