Criminal liability is intended to determine whether or not a perpetrator of a criminal act can be punished for a criminal act that he/she has committed. This is a normative study supported by empirical data using statutory approaches, conceptual approaches an case approaches. The problems addressed in this study are as follows: What is the criminal responsibility of land transportation companies in traffic accidents?; What form of application of criminal responsibility imposed on land transportation companies in cases 0f traffict accident?; And what obstacles affect the application 0f criminal responsibility? The results of this study indicate that the form of criminal liability that can be imposed on land transportation companies is in the form of vicarious liability accountability which allows the company to be responsible for the actions committed by company management who have the authority to carry out the activities of the c0mpany; There is also an inhibiting factor that cannot be enforced against a company that causes a traffict accident crime, namely the Act no.22 0f 2009 concerning Vehicles and Road Transportation that does not explicitly state the form of criminal responsibility for accidents caused by land transportation companies, in addition to the lack of professionalism of law enforcement officers in handling traffic accidents cases caused by land transportation companies.
