PEMBATALAN MEREK YANG MENGGUNAKAN NAMA ORANG TERKENAL BERLANDASKAN ASAS IKTIKAD TIDAK BAIK (ANALISIS KASUS PEMBATALAN MEREK ANTARA RUBEN SAMUEL ONSU MELAWAN YANGCENT).
This study discusses the cancellation of a brand using a famous person's name based on bad-faith principle related to a brand dispute between Ruben Samuel Onsu as a famous person against Yangcent as the founder of PT Ayam Geprek Benny Sujono. The focus of the problem in this study is the brand cancellation and the judge's legal considerations in the case's decision when viewed in the context of justice, and preventive legal protection efforts to protect trademark rights holders who register their trademarks based on good-faith principle in the future. This study used normative legal research methods and secondary data sources obtained from primary, secondary, and tertiary legal materials. Data were collected through literature review, and conclusions were drawn deductively. It was concluded that Ruben Samuel Onsu could not prove his argument that Yangcent, the owner of PT Ayam Geprek Benny Sujono, registered his trademark based on bad-faith principle, while Yangcent could prove otherwise, resulting in the cancellation of Ruben Samuel Onsu's trademarks. The judge's considerations in the two decisions in this case did not provide optimal justice for Yangcent because the Panel of Judges did not grant Yangcent's petition regarding the imposition of compensation and forced money as a result of the losses suffered by Yangcent. Preventive legal protection to protect trademark rights holders who register their trademarks based on good-faith principle in the future is to revise the trademark laws and regulations by adding provisions to include philosophical reasons for the brand name created.
