This thesis is entitled Immaterial Loss of Unlawful Acts Case Study of Decision Number: 124/Pdt.G/2013/PN.Mlg. The background to this article is that in Article 1365 of the Civil Code it is stated that "Any unlawful act which therefore causes harm to other people, obliges the person who because of his mistake caused the loss to compensate for the loss. Based on the provisions of this article, mistakes due to unlawful acts give rise to an obligation to provide compensation as a result of these actions. This made the writer interested in conducting research with the formulation of the problem. Is the judge's consideration in the case of an unlawful act in the Malang District Court decision number: 124/pdt.g/2013/pn.mlg correct and how to prove the occurrence of immaterial losses in an unlawful act. This type of thesis research is normative juridical research which is carried out by examining literature or secondary data with a statutory and conceptual approach as well as technical analysis of legal materials in this research is a study of literature and judge's decisions.
