PENEGAKAN HUKUM TERHADAP WARGA NEGARA ASING SEBAGAI PELAKU PENYALAHGUNAAN IZIN TINGGAL DI INDONESIA (STUDI KASUS DI KANTOR IMIGRASI KELAS I TPI PALEMBANG)
This thesis is entitled Law Enforcement Against Foreign Citizens as Perpetrators of Abuse of Residence Permits in Indonesia (Case Study at the Immigration Office Class I TPI Palembang). The background of writing the thesis is that there are many cases of abuse of residence permits by foreign nationals who are not subject to criminal sanctions as regulated in Article 122 letter a of Law Number 6 of 2011 concerning Immigration. The formulation of the problem that the author raises is law enforcement and rationality in imposing sanctions on foreign nationals who abuse residence permits. The writing of this thesis includes the type of juridical - empirical research, namely the type of sociological legal research or field research that aims to examine the legal provisions that apply to legal events that occur. From the results of the study, law enforcement against foreign nationals who abuse their residence permits can be subject to Pro Justitia Actions and Immigration Administrative Actions. Pro Justitia action is a legal action carried out through a judicial process in accordance with the criminal justice system, while Immigration Administrative Action is an administrative sanction given by the immigration party without going through a judicial process. The rationale for imposing sanctions to be given to foreign nationals who abuse their residence permit is fully determined by the Immigration Officer at every level of the organizational structure.
