The case of the widespread distribution of drugs without a distribution permit in society is of great concern to us as members of society. This can show that the level of public awareness of the law is still very low, so they tend to commit criminal acts, including distributing pharmaceutical drugs without a distribution permit. Therefore the authors conducted research based on this description with the title Application of Criminal Sanctions Against Perpetrators of Pharmaceutical Drugs Without a Distribution Permit (Decision Number 2116/Pid.Sus/2016/PN.Plg and Decision Number 2117/Pid.Sus/PN.Plg). The formulation of the research problem was conducted to find out how criminal sanctions are applied to perpetrators who distribute pharmaceutical drugs without a distribution permit and the efforts made to overcome them. This research uses normative research methods using secondary data through literature study, namely by conducting research on various library sources of books, laws and regulations relating to the crime of distributing pharmaceutical preparations without a distribution permit. From the results of the research conducted, it can be concluded that the criminal act of distributing pharmaceutical preparations without a distribution permit is regulated in Article 197 in conjunction with Article 106 of Law Number 36 of 2009 concerning Health, and the perpetrators in this case are subject to criminal sanctions based on the principle of guilt. The perpetrator was sentenced to 3 (three) months imprisonment and a fine of Rp. 3,000,000.- (Three Million Rupiah) functions as optimizing criminal law as a means of health prevention efforts. It is hoped that the implementation of this law will ensnare the perpetrators of the crime of distributing pharmaceutical drugs without a distribution permit. As well as the efforts made in handling this crime are carried out with a penal policy and a non-penal policy. Keywords: Criminal Sanctions, Drug Distribution, Distribution Permit
