abstrac A child should get protection from the family, the surrounding environment and the state. In Law Number 13 of 2003 there is a special article prohibiting a child from working beyond his capacity or meaning that a child is prohibited from being employed in heavy work that can endanger his life. However, in fact it was found that there are still many children working in the oil palm plantation sector and this has become commonplace in the Mandailing Natal Regency area with the assumption that they work to help the family's economy, even though child labor is prohibited because it can endanger the safety, health and mentality of children. The formulation of the problem from this research is how is the legal protection of child workers working in the oil palm plantation sector and what is the form of state responsibility for child workers working in the oil palm plantation sector. The method used is the normative method with a statutory approach and a case approach. The results of the study found that the form of preventive legal protection is by prohibiting the employment of children, guaranteeing the health and safety of children and protecting children from discrimination, as well as socializing the implementation of child protection while repressive, namely if the community finds violations against child labor then they can report it to the authorities and then carry out an investigation and investigations so that sanctions can be imposed; The form of state responsibility is fulfilling children's rights, supervising and providing protection for children, education programs that require a child to attend basic education for at least 9 (nine) years, and programs for empowering and improving the economy of underprivileged families.
