KOMPETENSI NOTARIS PENGGANTI ATAS PASAL 33 UNDANG-UNDANG JABATAN NOTARIS DALAM MEMBUAT AKTA AUTENTIK
Substitute Notary replaces the Notary during his leave. Substitute Notaries have the same powers, obligations and prohibitions as Notaries. This is as regulated in Article 33 of the Law on Notary Positions in paragraphs 1 and 2. In the laws and regulations there are no rules regarding the competence of a Substitute Notary as in the requirements that must be met by prospective Notaries. Therefore, this research raises problems regarding the competency setting of the Substitute Notary, the causes of the Substitute Notary's negligence and the regulation of the Substitute Notary's competence in the future. This research is a normative legal research with the support of empirical data. The theories used in this research are Legal Certainty Theory, Authority Theory, Responsibility Theory and Competency Theory. The results of the study explain that there is no competency setting. Substitute Notary is concretely in the laws and regulations relating to the appointment of a Substitute Notary. Negligence of the Substitute Notary is caused by the Substitute Notary who does not have sufficient knowledge in the legal world, is not careful and does not follow the operational standards of making a deed. Thus, it is necessary to amend the laws and regulations, especially the Law on Notary Positions in regulating the competence of Substitute Notaries.
