KEPATUHAN INDONESIA DALAM PEMENUHAN HAK SIPIL DAN HAK POLITIK BERDASARKAN UNDANG-UNDANG NOMOR 12 TAHUN 2005 STUDI PADA LEMBAGA PEMASYARAKATAN KELAS 1 PALEMBANG
This study aims to see the extent of Indonesia's compliance with the regime's ratification, namely the International Covenant on civil and political rights through LawNumber 12 of 2005 as a form of response to the existence of a mutually agreed international covenant. Theresponse form is the fulfillment of civil rights and political rights, which in this case is carriedout by research at the Class 1 Penitentiary in Palembang. This research is supported by compliance theory by Sarah Mc. Laughin. This type of research is qualitative, namelythesource of the data obtained through interviews and literature study. Based on this research, it was found that Indonesia's compliance is passive compliance, which means that Indonesiahas implemented the covenant but in its implementation it is certainly not easy, thereareobstacles, shortcomings and even ignorance of this covenant. This makes Indonesianot yet completely free from the issue of civil rights and political rights, especially in the researchsubject, namely the Palembang Class 1 Penitentiary.
