IMPLEMENTASI PROSTITUTION REFORM ACT 2003 TERHADAP PERLINDUNGAN HAK PEKERJA SEKS PADA MASA PEMERINTAHAN JACINDA ARDERN 2017-2021
New Zealand give attention to the discrimination and criminalization experienced by sex workers through the Prostitution Reform Act 2003. The aim of PRA 2003 is to protect the rights of sex workers as individual has their human rights. The purpose of this research is to find out how the implementation of PRA 2003 on the protection of the rights of sex workers during the reign of Jacinda Ardern 2017-2021. This research is a qualitative descriptive research. The data source of this research is secondary data. The data collection technique used is through the study of relevant literature such as scientific journals, books, news and websites and official New Zealand government documents. This research uses the concept of human security by UNDP and the concept of sex worker rights by IWRAW AP and NSWP. Through the concept of human security, implementation is seen through seven main security focuses. Through the concept of sex worker rights, as the focus of research, implementation is seen through the right to equal protection and freedom from discrimination, the right to freedom from stigma and prejudice, the right to freedom from violence, employment rights, health rights, privacy rights and freedom from arbitrary interference. authority, the right to marriage and family life and the right to social and economic security. As a result of the research, the implementation of PRA 2003 is carried out through government programs in several ministries and in collaboration with other non-governmental organizations as well as other policies related to PRA 2003. Examples are the prevention and testing program for infectious diseases (syphilis, chlamydia, HIV), in collaboration with NZPC, and the protection of the work environment through the Health and Safety at Work Act 2015. However, PRA 2003 does not fully address specifically the right to freedom from stigma and prejudice, as well as food security guarantees. In addition, the 2003 PRA does not completely eliminate crimes against sex workers but still provide the same legal protection for sex workers.
