Narcotics are substances that have characteristics. Narcotics can cause certain impact to those who use and put them into the body. The impacts are anaesthesia, loss of pain, excitement, and hallucinations or delusions. Along with the times, there are more and more types of drugs and various variations. One of the examples of a new form of drug is gorillas tobacco. Tobacco Gorilla or marijuana synthesis is herb common herbs or tobacco that is sprayed with a kind of a chemical synthesis whose outcome is resembling to the effect of psychoactive drug from hemp ( cannabis ) .How to operate from tobacco common same as people to smoke , to the damaged packaging wrapped up like packaging tea .Similar to marijuana synthesis capitals that in general , common tobacco or marijuana synthesis containing chemicals that commonly called cannabimimetics that can lead to the effect of hazard to the health of the body and very at risk when abused .There was an enhancement amount 0.03% on 2019. The enhancement was caused by enhance in the abuse of the new types of narcotics (New Psychoactive Substances) which in previous years had not been registered in the attachment to the constitution number 35/2009 and resulted a legal vacuum for the new types of narcotics. The author is interested to examine how to regulate this matter in the perspective of positive law in Indonesia and how to formulate criminal law policies in tackling the new types of narcotics. This research use normative analytical descriptive method with statutory approach also uses secondary data sources and tertiary legal materials. The result of this research is the formulation for the future of criminal law policies in order to dealing with these new types of narcotics.
