Children are an inseparable part ofthe continuity of human life and the sustainability of people and nation. Concrete measures are needed to prepare children's future so that the process of growing up into excellent human beings can happen by avoiding all disturbances like children in trouble with the law. In handling criminal acts including theft, there are two approaches as a reaction given to the perpetrators of criminal acts, both criminal and noncriminal justice approaches, which can be integrated as a "criminal policy". In Prabumulih City, the implementation of criminal policy to deal with criminal acts of theft by children has many constraints such as the absence of qualified investigators and the absence of institutions as required by the Law on the Child Criminal Justice Systenm, which have the potential to make the implementation of criminal policy not function optimally. This study was empirical legal research with explanatory characteristic. The results showed that the implementation of criminal policy to combat criminal acts of theft committed by children in Prabumulih City did not function optimally. Constraints in the implementation through the penal approach were caused by the legal factors themselves: law enforcers, facilities and infrastructure, community, and legal culture. Constraints through the non-penal approach are caused by internal and external factors. The ideal criminal policy could be achieved by integrating the implementation of criminal policy through penal and non-penal approaches as well as making improvements and fulfilling predetermined provisions.
