PENGENAAN SANKSI ADMINISTRATIF TERHADAP WARGA NEGARA YANG MENOLAK VAKSIN COVID-19 DI TINJAU DARI PERSPEKTIF HAK ASASI MANUSIA
he Covid-19 pandemic has had an impact in various areas of human life. One of the efforts made by the government in order to reduce the impact of COVID-19 by providing vaccines to the community. In order to support the national vaccination program to run smoothly, the President stipulated Presidential Regulation No. 14 of 2021 concerning Vaccine Procurement and Vaccination Implementation in the Context of COVID-19 Pandemic Response, one of the things contained in the Regulation is administrative sanctions for citizens who refuse vaccines that have been designated as recipients of the COVID-19 vaccine. Therefore, the author is interested in discussing some of the following: 1. How is the arrangement for the imposition of administrative sanctions for citizens who refuse the COVID-19 vaccine? 2. How is the protection of people's rights against the imposition of administrative sanctions for those who refuse vaccines? This research is normative research that uses a statutory approach and an analytical approach. The result of this study is 1. The regulation of the imposition of administrative sanctions for citizens who refuse vaccines is regulated in Article 13A Paragraph (4) of Presidential Regulation No. 14 of 2021, one of which is the delay / termination of social security for those who refuse vaccines, this is contrary to the National Social Security System Law guaranteeing everyone who has paid dues or dues paid by the government and the Government's Human Rights Law is obliged to respect Human Rights and the Constitution guarantees that everyone is entitled to the fulfillment of social security stipulated in Article 28 H paragraph (3) of the 1945 NRI Constitution 2. The protection of people's rights on social security is mandated in Article 28 H paragraph (3) of each person entitled to social security that allows his or her full development. Article 41 Paragraph (1) of the Human Rights Law also explains that every citizen is entitled to the social security needed to live a decent life.
