ALASAN HUKUM PENOLAKAN ARBITER OLEH PARA PIHAK DALAM PROSES ARBITRASE INTERNASIONAL
Article 2 Point 3 of the Charter of the United Nations states that all members shall settle their international disputes by peaceful means. Along with the mandate from the Charter of the United Nations, there are several methods of pacific settlement that can be used, one of them is arbitration. The tendency of the traders to choose arbitration can’t be separated from the high level of efficiency from the arbitration process, which many of them are reflected in the advantages of arbitration itself. However, keep in mind that one of the advantages of arbitration, which is the right to choose an arbitrator, is also come along with the right of the parties to challenge the arbitrator. The right to challenge the arbitrator is something that must be regulated, but this can also be a serious problem when we see it as a prevention from getting the high level of efficiency from the arbitration process. This study will examine about the legal reasons to challenge the arbitrator by the parties in the international arbitration process from the perspective of efficiency and the legal effect from challenging the arbitrator by the parties in the international arbitration process. This study is normative research using a statute approach; conceptual approach; and comparative approach. The data sources of this study include a primary legal material; secondary legal material; and tertiary legal material, which will be analyzed qualitatively. Deductive method will be used to get the conclusions. From the results of the study, several things were found: 1) The right of the parties to challenge the arbitrator have efficiency in an international arbitration process, and 2) The challenge to the arbitrator by the parties will cause the international arbitration process to be inefficient.
