SURAT KETERANGAN (COVERNOTE) NOTARIS/PEJABAT PEMBUAT AKTA TANAH SEBAGAI DASAR PENCAIRAN KREDIT BANK (KAJIAN DARI ASPEK KEDUDUKAN, PERTIMBANGAN, DAN TANGGUNGJAWAB HUKUM)
The notary issues a covernote because he has not yet completed his work in relation to his duties and authority to issue an unfinished authentic deed as part of the bank credit disbursement process. The notary issues a covernote as a temporary legal umbrella before all processes at the PPAT office are completed until the certificate is handed over to the creditor. The purpose of this study is to determine the legal position of the Notary's covernote, the legal considerations of the bank that use the covernote as the basis for credit disbursement, and the Notary's legal responsibility if the covernote causes legal problems that harm prospective debtors. . This research uses normative legal research methods. The results of this study conclude that the position of the covernote in the practice of a notary is that it is only morally binding that arises on the basis of need and practice and is only an introduction and temporary evidence as a guide for the bank that will issue credit. Bank's legal considerations that use a covernote as the basis for a credit agreement, namely because the credit agreement is classified as a form of agreement that binds the parties even though the laws and regulations are not regulated but are regulated based on the legal requirements of an agreement in the Civil Code while non-legal considerations are due to trust. between the bank and the notary. The responsibility of the notary in issuing the covernote for the disbursement of bank credit if it causes a loss to the bank/debtor is that the notary is fully responsible for the contents of the covernote that is issued if it contains incorrect information, namely in the form of criminal or civil.
