In carrying out his/her office administration, a Notary public definitely needs employees, and these employees are usually people who are also actively involved in the process of making authentic deeds, that we then call instrumentair witnesses. The objectives of this study are to explain the legal position of instrumentair witnesses who still have blood relations with a Notary public; to reveal legal weaknesses related to the position of instrumentair witnesses who have blood relations with a Notary public in making a notarial deed; and to elaborate on the efforts that should be made to overcome the problem of using instrumentair witnesses who still have blood relations in carrying out the profession. This is a normative study using a statutory approach, scientific works, books, journals related to the topic of writing. This study uses the primary, the secondary and the tertiary legal materials. The results of this study confirm that instrumentair witnesses are actually actively involved in the process of making an authentic deed, because the law requires that a minimum of 2 witnesses must be present in making the deed. The weaknesses related to the position of the instrumentair witness emerged only when it turned out that in terms of proving the position of the instrumentair witness, he had a blood relationship with a Notary 'and because ofthat relationship his testimony had no value and was contrary to the legal requirements to become a witness. In conclusion, we should conduct counseling and update law enforcement regarding the appointment of Notary employees so as not to appoint blood relatives to be instrumentair witnesses, besides that we must also increase our legal awareness to continue obeying the applicable rules.
