ABSTRACT LEGAL PROTECTION FOR THE RESIDENCE OF TAMAN OGAN PERMAI FROM THE HOUSING DEVELOPER OF PT. AMEN MULIA FOR LAWSUIT AGAINS THE LAW (DECISION STUDY NUMBER 126/PDT/2018/PT.PLG) By; Johanto, Annalisa Yahanan, Agus Trisaka In housing development, a lot of developers experience dispute issues regarding the house building sites. This study aims at analyzing (1) the judge's legal consideration concerning Taman Ogan Permai resident protection based on the verdict No. 126/PDT/2018/PT.PLG, (2) roles and responsibilities of the National Land Agency in the issuance of certificates as the object of the Property Sales and Purchase Agreement and, (3) role of Notary Public in the Sale and Purchase Agreement between PT. Amen Mulia, as the developers, with the residents of Taman Ogan Permai. It is a normative research with regulation,conceptual, case, and comparative approaches. The results of the analysis show that honest buyers with good intention are the ones who received the legal protection. Based on this, it is appropriate for the Plaintiffs to be declared as buyers with good intention who also deserve legal protection. Furthermore, the judge needs to consider that the land with official certificate in the name of the person or legal entity that acquired the land with good intention and actually controls it must be protected since this is the loss of the consumers. The role of the Notary/ Land Deed Official in the sales agreement is to write a deed that has certainty of content, date and subject or person, in which it has the absolute power of proof and binds the parties and applies as regulation for those who has written it down. It is concluded that every consumer who takes legal action with good intention must be protectęd, because every party who causes other people to suffer losses must pay the compensation.
