PERLINDUNGAN HUKUM BAGI PEMEGANG HAK MEREK DAGANG DALAM KONTRAK BISNIS ELEKTRONIK
In the regulation of electronic commerce in Indonesia, the organizers are only required to make an electronic contract with the seller as from of legal protection for trademark. This study examined the problems of how was the legal force of electronic business contracts made by the marketplace as a form of trademark protection in electronic trading transactions in terms of the Civil Code and the Law on electronic information and transactions, how to enforce the law against trademark infringement in elecetronic trading transactions, and how the legal regulations should be related to circulation of goods to avoid infringement of trademark in electronic commerce. This was normative legal research using the statutory approach, conceptual approach, cyber-law approach, and comperative approach by examining legal materials consisting of primary, secondary and tertiary legal materials processed in systematic analysis. The theoretical bases of the the research were legal certainty, expedience, legal protection and intellectual property rights protection. The data were analyzed by using legal interpretation. The results of the study show that the electronic contracts made by marketplace parties in protecting trademarks based on the Civil Code and the Law on electronic information and transactions are still very weak because the contracts in the Law on electronic information and transaction are not the same as the contracts stipulated in the Civil Code so that the contracts have the potential not to provide legal certainty. As for trademark infringement in electronic commerce, it is the full responsibility of the organizers, but the from of marketplace responsibility is only deleting online store websites that commit trademark infringement without any blocking. Future regulations related to the circulation of goods in electronic commerce should include rules and clauses containing elements of agreements in the Civil Code, and establish an institution that supervises business doers in electronic trading activities so that trade is more structured and can guarantee the quality of products traded electronically.
