The ownership of SPHAT that still exists today and its transfer with the deed of transfer of right are still common, especially in Banyuasin Regency, even though based on practice there are also many overlapping SPHATs so that they cannot be registered at the Land Office. Therefore, the tittle in this study is the validity of the letter of recognition of land rights and the deed of transfer of rights as a basis for registration at the Banyuasin Regency Land Office. Based on this, formulation of the problems in this study are as follows: how was the validity of SPHAT and the deed of transfer of rights and how was the procedure for registration at the Land Office of Banyuasin Regency. To discuss and answer the formulation of problem, Legal Certainty Theory as Grand Theory, Land Adminstration Theory as Middle Theory and Good Faith Theory as Aplplied Theory were used. This research used the Normative-Empirical Method. The results showed that the validity of the SPHAT and the Deed of Transfer of Rights depended on the judge's assessment in the trial whether the manufacturing process was in accordance with the laws and regulations and whether the control was in accordance with the determination and utilization. In terms of the procedure for registration of SPHAT and the Deed of Operation, it is further regulated in Appendix III of Perkaban Number 1 of 2010 concerning service standards and land regulations. Researchers recommend that SPHAT holders physically control and use the land on the basis of the initiative of SPHAT holder or through the PTSL program run by the gove, use and control and on the basis of the initiative of SPHAT holders or through the PTSL program run by the government so that land owners immediately register lands that have not been certified to achieve legal certainty of land ownership Keywords: Deed of Transfer of Rights, Land Registration, Letter of Recognition of Land Rights (SPHAT)
