This study aims at determining and analyzing the legal protection for the substitute notary who is not aware of fake identities from parties in the situation that the provious notary has died and to analyze the obstacles in providing the legal protections. It is a normative legal research with secondary data sources. Three approaches were used, i.e. statute approach, conceptual approach, and case approach. The resulted legal protection forms were: the use of rights or obligations of notary to refuse; summon approval from honorary council of public notary (MKN) of any summons from investigators, public prosecutors and judges; supervision; fingerprints attachment to the minutes of deeds; and legal protection from the notary public organization (INI). The legal protection for substitue notary in case that the previous notary has dead before has full devotion aginst fake identity can be; goverment reviewing laws regulation, particularly of using and renawal identity of making authentic deed.
