ANALISIS PASSIVE COMPLIANCE INDONESIA DALAM CONVENTION ON THE RIGHT OF THE CHILD TERKAIT ANAK YANG BERHADAPAN DENGAN HUKUM
Handling about Children in Conflict with the Law (ABH) is a for the government and society. Child delinquency in the current era of globalization is no longer a simple phenomenon, but has expanded to become a very worrying issue. Currently, many child delinquencies are included in the category of crimes that require a child goes through an criminal punishment many kinds of solutions and alternatives that involve children in the legal process must ensure that children's rights are handled in a manner that is appropriate for children their age. The discussion in this research focuses on analysis of Indonesia’s role in its compliance with the Convention on the Right of the Child regarding to Children in Conflict with the Law (ABH), to find out how Indonesia protects the rights of Children in Conflict with the Law (ABH). Qualitative descriptive methodologies used in this research to obtain in-depth analysis. This research uses indicators from international regime compliance theory to analyze field findings. The results of the analysis show that Indonesia is in the level of passive compliance about its compliance with the Convention on the Right of the Child. Indonesia has carried out the commitments that have been agreed, but it has little effect on the condition of implementation the rights of Children in Conflict with the Law (ABH).
