The thesis entitled Corporate Legal Liability Against Termination of Employment Due to Efficiency Reasons (Study of Supreme Court Cassation Decision Number 309 K/Pdt.Sus-PHI/2018) is motivated by the provisions of Article 164 Paragraph (3) of Law Number 13 of 2003 which states that Employers can terminate employment for reasons of efficiency followed by the company closing. However, the case for terminating the employment relationship of PKWTT workers for reasons of efficiency carried out by the company in the Supreme Court's Cassation Decision Number 309 K/Pdt.Sus-PHI/2018 was not marked by the company closing. The problem discussed in this thesis is whether the case of terminating PKWTT workers for reasons of efficiency carried out by the company in the Supreme Court cassation decision Number 309 K/Pdt.Sus-PHI/2018 has been in accordance with the efficiency criteria stipulated in the Act. Number 13 of 2003 and how the company is responsible for PKWTT workers who are terminated for reasons of efficiency. This research is a normative research using a statutory approach, a conceptual approach, and a case approach. The results of this study conclude that the termination of the employment relationship of PKWTT workers for reasons of efficiency carried out by the company in the Supreme Court Cassation Decision Number 309 K/Pdt.Sus-PHI/2018 is not in accordance with the provisions of Article 164 Paragraph (3) of Law Number 13 Year 2003, because the company terminated the employment relationship, it was not indicated by the company closing and the company terminating the employment relationship of PKWTT workers for reasons of efficiency.
