Territorial waters breach in Indonesian Exclusive Economic Zone happens because the abundant fish resource in Malacca Strait, so much of the foreign fisherman is using that fisheries potential to do some illegal fishing. The purpose of this research is to identify the type and quantity of the breach that been caused by illegal fishing, and effort that has been done by the authorized agency in Malacca Strait water. The analysis that used is qualitative method with case study, and comparative descriptive analysis. The obtained research result is that in year 2009 to 2011, the number of ships that violate because doing the fisheries criminal offense illegal fishing as many as 44 foreign ships. The illegal fishing violation types that happen are 1). The incompleteness of the license document like fisheries business license (SIUP), fishing license (SIPI), and fishing area allowance (DPI), 2). Fishing gear utilization territorial violation, 3). Inactivating communication tool (transmitter). Effort that has been done by the authorized agency is perform and intensify the control patrol frequency between agency, implement the socialization to fishermen’s group, perform vessel’s license document checking and de jure processing toward illegal fishing breach.
